Definitions

“The Videographer” means Tyander Studio. “The Client” means any person, body of persons, firm, or Company with whom the Videographer enters a contract for the sale of goods or provision of services by the Videographer.

Permissions

The client is responsible for obtaining all necessary permissions from individuals and locations featured in the video.

Accepting the Offer and Signing the Agreement

a. The offer is valid for 14 calendar days. The agreement is accepted by paying the 1st instalment which acts as a contract between the Client and Videographer.

b. Once the agreement is signed by both parties, an invoice will be sent in 48 hours, and this needs to be paid in 10 calendar days.

Payment Terms

a. The full fee of the video is payable in 3 instalments, unless agreed otherwise.

b. 50% of the agreed price acts as a deposit and is to be paid as an acceptance of the offer, also to secure the booking of the date. Client is not deemed to have accepted the offer (nor secured the agreed date of the shoot) until the deposit has been paid in full. Failure to pay the deposit may result in the withdrawal of the offer. This instalment in non-refundable.

c. 25% of outstanding balance is payable on the day, prior to the shoot.

d. Final 25% is to be paid upon the Client’s final approval and completion of the video.

e. The final non-watermarked version will be uploaded and the download link will be sent via email once the 3rd instalment has been received by the Videographer.

f. Both parties have the right to request to postpone the shoot, the new agreed date must take place within 30 calendar days, dependent upon the Videographer’s availability.

g. In the event of cancellation from the Client’s side, there is no refund of the 1st instalment. If a new video shoot is requested, the deposit is to be paid again as it is treated as a new offer.

h. In the event of cancellation from the Videographer, there is a full refund of the 1st instalment in 14 days on a bank account provided by the Client.

i. In the event of unforeseen circumstances, arrangements will be made and discussed on a case-by-case basis.

Sharing and Storage

a. Video edits will be shared via Google Drive.

b. It is the client’s responsibility to back-up/download the edits to their own drive/USB/computer for further viewing and safe keeping.

c. Edits as well as raw footage will be stored on Google Drive for 3 calendar months after completion of the video, and then deleted from the Tyander Studio Google Drive account. The Videographer will include the date of deletion in the email with your final video. Client is then responsible for storage of all files which are available to download on their part.

a. The copyright of all footage created by the Videographer is owned by the Videographer and unless otherwise stated, the Client will receive an edited selection of high-definition footage.

b. If the Client wishes to obtain raw footage this will incur a “release fee” of £300 and additional costs may be incurred if the footage is to be sent via a physical format such as USB, DVD, etc.

Right to Promote

The Videographer reserves the right to use Clients' video(s) as promotional material for their website or social media platforms, unless requested otherwise by the Client.

Fees and Expenses

The prices quoted to the Client are specifically based on the initial job description and specifications provided to the Videographer. If these details undergo any alterations or modifications before or during the assignment, the Videographer retains the right to impose additional charges for fees and expenses. The Videographer will make a concerted effort to offer an estimate of these supplementary costs whenever feasible.

Delivery of Products and Services

a. The Videographer shall reasonably endeavour to meet agreed deadlines where applicable, but will not be liable for delays that are beyond their control.

b. The final video will be handed over via email with a link to download your file(s) from, and unless agreed otherwise, this is the only form of delivery from the Videographer.
c. The final-non watermarked video will be handed over once the 3rd instalment of the payment has been received by the Videographer.

Liability

In the event of any loss or damage to footage, Tyander Studio’s liability will be limited to a refund of all monies paid.
